Truth and justice may be the American way, but when it comes to prosecuting an individual for alleged crimes, things aren’t always black and white. There are numerous options available to a prosecutor dealing with a case, and numerous factors to take into consideration when weighing what route to take when having someone tried for supposed misdeeds. Issues such as effect on the family, past record, and expectations for future behavior all play a role when setting bail, levelling charges, and requesting a sentence. What is the Torah’s view on dealing with alleged criminals? How much leeway do lawyers and judges have to lay off or lay it on thick? When is mercy called for, and when should one demand the letter of then law?
